1. Introduction

These Terms and Conditions (“Terms”) govern the use of Listberg.com (the “Platform”), owned and operated by LISTBERG SERVICES (OPC) PRIVATE LIMITED (“Listberg”, “Company”, “we”, “our”, or “us”).

By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you must discontinue use immediately.

2. Nature of the Platform

Listberg.com is a digital advertising platform that provides space for users (“Advertisers”) to post advertisements.

LISTBERG SERVICES (OPC) PRIVATE LIMITED:

  • Provides advertising space only.
  • Does not verify the identity of advertisers.
  • Does not verify the authenticity, legality, or accuracy of advertisements.
  • Does not act as an agent, broker, intermediary, guarantor, or representative in any transaction.
  • Does not participate in, control, supervise, or facilitate transactions between users.

The Platform is purely an advertising medium.

3. Anonymous Use and Minimal Oversight

Users acknowledge that:

  • Advertisements may be posted by anonymous users.
  • The Platform operates with minimal moderation and oversight.
  • Content may not be reviewed prior to publication.

LISTBERG SERVICES (OPC) PRIVATE LIMITED is under no obligation to monitor, verify, or validate user activity or advertisements.

4. User Responsibility and Assumption of Risk

All interactions, communications, negotiations, and transactions conducted through the Platform are undertaken at the sole risk of the users involved.

Users are solely responsible for:

  • Performing due diligence before engaging in transactions.
  • Verifying the legitimacy of advertisers or third parties.
  • Protecting themselves against fraud, scams, or misrepresentation.

The Company shall not be liable for any consequences arising from reliance on advertisements.

5. No Liability for Third-Party Misuse

To the fullest extent permitted by applicable law, LISTBERG SERVICES (OPC) PRIVATE LIMITED shall not be liable for:

  • Fraud, scams, deception, or misrepresentation by users.
  • Loss of money, property, or data resulting from transactions.
  • Misuse of the Platform by third parties for personal gain.
  • Disputes between advertisers and third parties.
  • Claims made by advertisers regarding business losses.
  • Indirect, incidental, special, consequential, or punitive damages.

All responsibility for advertisement content and resulting outcomes lies solely with the advertiser and interacting parties.

6. Advertiser Representations and Warranties

Advertisers represent and warrant that:

  • They have legal authority to publish their advertisements.
  • Their content complies with all applicable laws and regulations.
  • Their advertisements are not fraudulent, misleading, defamatory, or unlawful.
  • Their content does not infringe intellectual property or privacy rights.

The Company does not review, approve, endorse, or guarantee advertisement content.

7. No Endorsement

The appearance of any advertisement on the Platform does not constitute endorsement, approval, recommendation, or verification by LISTBERG SERVICES (OPC) PRIVATE LIMITED.

8. Limitation of Liability

The Platform is provided on an “as is” and “as available” basis without warranties of any kind.

Under no circumstances shall LISTBERG SERVICES (OPC) PRIVATE LIMITED, its directors, officers, employees, agents, or affiliates be liable for:

  • Direct or indirect financial loss
  • Loss of profits or business opportunity
  • Data loss
  • Reputational harm
  • Any damages arising from use or inability to use the Platform

If liability is imposed by law despite these limitations, total liability shall not exceed the amount paid by the advertiser for the specific service giving rise to the claim.

9. Indemnification

Users agree to indemnify, defend, and hold harmless LISTBERG SERVICES (OPC) PRIVATE LIMITED from any claims, liabilities, damages, losses, or legal expenses arising from:

  • Their use of the Platform
  • Their posted advertisements
  • Violation of applicable laws
  • Disputes with other users
  • Misuse of the Platform

10. Content Removal and Suspension

The Company reserves the right, but not the obligation, to:

  • Remove any content at its discretion
  • Suspend or terminate user access
  • Restrict platform usage without notice

Failure to remove certain content does not imply responsibility or approval.

11. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of Goa India.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Goa India

12. Amendments

LISTBERG SERVICES (OPC) PRIVATE LIMITED reserves the right to modify these Terms at any time. Continued use of the Platform constitutes acceptance of revised Terms.
